Student Agreement (CNA Program Terms and Conditions)
📘 Program Requirements
I will attend all scheduled classes, labs, and clinical rotations as outlined in the program curriculum.
I will complete all assigned coursework, assignments, and examinations to the best of my ability.
I will adhere to Bay Area CNA School’s policies, rules, and regulations while enrolled in the CNA program.
💰 Financial Obligations
I acknowledge that tuition and fees are due according to the payment schedule provided by Bay Area CNA School.
I agree to make timely payments for all financial obligations associated with the program.
I understand that failure to meet payment deadlines may result in suspension or dismissal from the program.
I understand that the Live Scan and State certification exam fee is not included in my tuition.
🧑⚕️ Code of Conduct
I will conduct myself professionally and respectfully toward instructors, staff, fellow students, patients, and others associated with the program.
I will maintain patient confidentiality and adhere to ethical standards.
I will follow all infection control and safety protocols as instructed by faculty and clinical site staff.
📚 Academic Integrity
I will not engage in academic dishonesty, including plagiarism, cheating, or unauthorized collaboration.
I understand that violations of academic integrity may result in disciplinary action, including dismissal.
🎓 Program Completion & Certification
I understand that successful completion of the CNA program does not guarantee employment or certification.
I will fulfill all program requirements, including achieving minimum passing grades and demonstrating clinical competence.
I am responsible for registering for and passing the state certification examination to become a licensed CNA.
⚠️ Liability Waiver
I understand and agree that participation in the CNA program may involve exposure to risks, including but not limited to physical injury, illness (including communicable diseases), emotional distress, or property damage.
I voluntarily assume all such risks.
I hereby release and hold harmless Bay Area CNA School, its owners, instructors, staff, affiliates, and clinical partners from any and all liability, claims, demands, or causes of action arising out of or related to my participation in the program, including clinical training.
📅 Attendance & Makeup Classes
I understand that attendance is mandatory for all scheduled classes, labs, and clinical rotations.
Makeup classes may be offered based on availability, but due to CDPH Regulations limiting class size, missed clinical classes may not be immediately rescheduled.
Excessive absences may result in dismissal from the program.
🔁 Refund & Withdrawal Policy
I understand that tuition refunds are subject to Bay Area CNA School’s refund policy.
If I choose to withdraw, I must submit a written notice.
Refunds, if applicable, will be calculated based on the date of withdrawal in accordance with the school’s refund policy.
📘Background Check & Certification Disclaimer
The California Department of Public Health (CDPH) is solely responsible for reviewing Live Scan background checks and determining eligibility for CNA certification. The school does not receive, review, or have access to any student’s Live Scan results.
Enrollment in the CNA program and completion of training does not guarantee approval by CDPH or eligibility for certification.
If CDPH denies certification due to criminal history or any other reason, tuition and fees are non‑refundable, as the school has fulfilled its obligation to provide the training program.
📸 Media Release
I grant Bay Area CNA School permission to use photographs, video recordings, or testimonials featuring me for educational or promotional purposes, unless I opt out in writing.
⚖️ Dispute Resolution & Arbitration Clause
Any dispute, claim, or controversy arising out of or relating to this agreement, the CNA program, or the relationship between the student and Bay Area CNA School—including but not limited to claims of breach, negligence, or statutory violations—shall be resolved exclusively through final and binding arbitration.
The arbitration shall be conducted in accordance with the rules of the American Arbitration Association (AAA) or another mutually agreed-upon arbitration body.
The arbitration shall take place in Alameda County, California, and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.
Both parties waive their right to a jury trial and agree that arbitration shall be the sole and exclusive forum for resolving disputes.
Each party shall bear its own costs and attorney’s fees unless otherwise determined by the arbitrator.
